Welcome to YellowBrik. These Terms & Conditions ("Terms") govern your use of the YellowBrik platform, website, applications, and related services (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to these Terms.
1. Eligibility
YellowBrik is intended for:
- Parents or legal guardians age 18 or older
- Teen users age 14 or older
- Employers engaging in lawful employment onboarding activities for minors
YellowBrik is not directed to children under the age of 13. Users under 13 are prohibited from creating accounts or using the Services directly.
YellowBrik is currently only available in approved launch states. Access from unsupported jurisdictions may be restricted or blocked.
2. Nature of the Services
YellowBrik provides tools and workflows designed to assist families and employers with employment preparation, workers permit workflows, document storage and sharing, employment onboarding coordination, and related administrative activities.
YellowBrik is not a law firm, government agency, payroll provider, tax advisor, employment agency, or healthcare provider.
YellowBrik does not guarantee:
- Employment
- Government approval of permits
- Employer participation
- Compliance by third parties
- Legal outcomes
Users remain solely responsible for ensuring all submitted information is accurate and lawful.
3. Parent Responsibility
Parents and legal guardians are solely responsible for supervising minor use of the Services, reviewing documents before submission, authorizing document sharing, and maintaining account security.
By creating an account for a minor, the parent or guardian represents they have authority to consent on behalf of the minor.
4. Teen Accounts
Teen accounts are subordinate to a parent or guardian account. Teen users may only access and use features permitted by the parent account.
Upon reaching the age of majority, YellowBrik may allow transition of account ownership directly to the former minor user.
5. Electronic Signatures & Consent
By using YellowBrik's e-signature workflows, users consent to conduct transactions electronically pursuant to the ESIGN Act and UETA.
Electronic signatures, audit logs, timestamps, IP addresses, and authentication records may be retained as evidence of execution and intent.
YellowBrik facilitates signature workflows but does not independently verify the legal validity, enforceability, or acceptance of signatures by employers, schools, or government agencies.
6. Workers Permit & Employment Documents
YellowBrik assists in facilitating workers permit and onboarding workflows for minors. Requirements vary by state, employer, school district, and labor authority.
Users are solely responsible for compliance with all applicable employment, tax, labor, and child labor laws.
YellowBrik does not independently verify the accuracy of permit information or employment eligibility.
7. Social Security Number Handling
YellowBrik does not store Social Security Numbers ("SSNs") in its databases, logs, backups, caches, or persistent storage systems.
SSNs entered during document completion are held temporarily in server memory solely for the purpose of populating required documents and transmitting those documents to authorized recipients. After transmission and completion, the SSN is discarded from YellowBrik systems.
Users acknowledge that employers, schools, government agencies, or downloaded copies of completed documents may independently retain SSNs outside of YellowBrik's control.
8. Document Storage & Sharing
Users may upload, store, and share documents through the platform. Users represent they possess all necessary rights and permissions to upload any document.
YellowBrik is not responsible for misuse of documents after they are shared, downloaded, or accessed by authorized recipients.
Parents may restrict or approve sensitive document sharing at their discretion.
9. Privacy & Security
YellowBrik uses commercially reasonable safeguards including encryption, access controls, and authentication procedures to protect user data.
A separate Privacy Policy governs the collection, use, storage, and disclosure of personal information and is incorporated into these Terms by reference.
No electronic system can guarantee absolute security. Users acknowledge that electronic transmission and storage involve inherent risks.
10. Subscription Billing
Certain features require a paid subscription. By subscribing, users authorize recurring charges until cancellation.
Fees are generally non-refundable unless required by law. YellowBrik reserves the right to modify pricing with advance notice.
11. Acceptable Use
Users agree not to:
- Upload fraudulent or unlawful documents
- Attempt unauthorized access
- Misrepresent identity or authority
- Interfere with platform operations
- Upload malicious code or malware
- Use automated systems to scrape or abuse the Services
Violation may result in suspension or termination of access.
12. Third-Party Services
YellowBrik may integrate with third-party providers including payment processors, cloud storage providers, authentication vendors, e-signature providers, and messaging services.
YellowBrik is not responsible for third-party systems, outages, acts, omissions, or policies.
13. Intellectual Property
All platform software, branding, workflows, content, and materials are owned by YellowBrik or its licensors.
Users receive a limited, revocable, non-transferable license to use the Services for authorized purposes only.
14. User Termination & Data Deletion
Users may terminate their accounts at any time by discontinuing use of the Services and requesting account deletion.
YellowBrik may retain certain records where required by law, compliance obligations, fraud prevention, audit logging, dispute resolution, or security purposes.
YellowBrik may suspend or terminate accounts for violations of these Terms, fraud concerns, or security risks.
15. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
YELLOWBRIK DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.
YELLOWBRIK DOES NOT GUARANTEE ERROR-FREE OPERATION, JOB PLACEMENT, OR GOVERNMENT ACCEPTANCE OF DOCUMENTS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YELLOWBRIK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
YELLOWBRIK'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT PAID BY THE USER TO YELLOWBRIK DURING THE PRIOR TWELVE (12) MONTHS; OR
(b) $500 USD.
CERTAIN JURISDICTIONS MAY NOT ALLOW LIMITATIONS OF LIABILITY, SO SOME LIMITATIONS MAY NOT APPLY.
17. Arbitration & Class Action Waiver
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration conducted in Missouri, except where prohibited by law.
Users agree to waive any right to participate in class actions, class arbitrations, or representative proceedings against YellowBrik.
Either party may seek relief in small claims court for qualifying disputes.
18. Data Breach Notifications
In the event of a confirmed security incident involving personal information, YellowBrik will provide notifications consistent with applicable state and federal law.
Where appropriate and legally required, YellowBrik may offer remediation measures such as credit monitoring.
19. DMCA & Intellectual Property Complaints
If you believe content uploaded through the Services infringes your intellectual property rights, you may submit a notice to YellowBrik requesting removal of the allegedly infringing material.
YellowBrik reserves the right to remove content and terminate repeat infringers.
20. Governing Law
These Terms shall be governed by the laws of the State of Missouri, without regard to conflict of law principles.
Any disputes not subject to arbitration shall be resolved exclusively in Missouri courts.
21. Changes to These Terms
YellowBrik may update these Terms periodically. Continued use of the Services following updates constitutes acceptance of revised Terms.
